Terms of Service

Welcome to Diasfrica. These Terms of Service ("Terms") govern your use of our websites, applications, and services (the "Platform"). By using the Platform, you agree to these Terms.
1. Eligibility and Accounts
- You must provide accurate account information.
- You are responsible for activity on your account and keeping your credentials secure.
- You must comply with applicable laws and platform policies.
- Additional verification may be required before enabling host or vendor capabilities.
2. Event Listings and Content
- Hosts are responsible for the accuracy of event details, pricing, schedules, and policies.
- Vendors are responsible for the accuracy of vendor profiles, service offerings, quotes, and fulfillment commitments.
- You grant Diasfrica a non-exclusive license to display and distribute content you upload to operate the Platform.
- We may remove content that violates law, policy, or safety standards.
3. Ticketing and RSVP
- Free event RSVP and paid ticketing (when enabled) are subject to event-specific terms.
- Hosts are responsible for event fulfillment, check-in operations, and attendee communications.
- Diasfrica may suspend or limit ticketing features for fraud, abuse, or policy breaches.
4. Fees and Payouts
- Platform fees, payout timelines, and any processing costs are disclosed in relevant host workflows.
- Payouts may be delayed for risk review, disputes, chargebacks, or compliance checks.
- Diasfrica uses third-party payment and payout providers, including Stripe Connect for diaspora vendor marketplace payouts.
4A. Vendor Accounts and Marketplace Services
- Vendor features are available only after completing onboarding requirements shown in-app, including terms acceptance, profile setup, role activation, and payout setup where required.
- Vendors must provide truthful business identity, service categories, locations, and response details, and keep this information current.
- Vendors are solely responsible for service quality, legal compliance, permits, taxes, invoicing, and delivery of agreed services.
- Diasfrica may suspend, limit, or revoke vendor access for fraud risk, policy breaches, abuse, failed verification, repeated disputes, or non-performance.
- Diasfrica may hold, offset, or reverse vendor-related settlements where bookings are cancelled, refunded, charged back, disputed, or flagged by compliance controls.
4B. Flyer Design and Event Promotion Services
- Diasfrica may offer flyer design and optional event promotion support based on the information submitted by an organizer.
- Flyer design requests are reviewed before work begins, and payment is required before any design work starts.
- Diasfrica may adjust final pricing before payment based on the complexity, scope, turnaround needs, missing assets, or material changes to the request.
- Each flyer design package includes a limited number of revisions as described in the selected package or service flow.
- Revisions apply to the original approved brief. Major changes, including new concepts, event changes, or full redesign requests, may require added fees or a new scope.
- Turnaround times are estimates only and may vary based on workload, organizer responsiveness, brief completeness, and delivery of required assets or feedback.
- Organizers are responsible for providing accurate event information, correct spelling, complete details, and all required assets such as logos, images, and references.
- Diasfrica is not responsible for errors caused by inaccurate, incomplete, or late information supplied by the organizer.
- Event listing or promotion on Diasfrica remains optional and subject to review under platform policies.
- Payment for flyer design does not guarantee automatic listing, featured placement, event approval, ticket sales, attendance outcomes, or performance on third-party platforms.
- Organizers may request cancellation before work begins. Once work has started, cancellations may be denied and refunds may not be available.
- Before work begins, Diasfrica may issue a full or partial refund minus processing or administrative costs. After work has started, refunds are generally not available unless Diasfrica determines otherwise.
- If Diasfrica is unable to deliver the agreed service, a full or partial refund may be issued at Diasfrica's discretion.
- Upon full payment, the organizer receives rights to use the final flyer for event promotion. Unless otherwise agreed, Diasfrica may display completed work for portfolio, promotional, or service-marketing purposes.
5. Prohibited Conduct
- Fraud, impersonation, abuse, scraping, system interference, and illegal content are prohibited.
- You may not use the Platform to violate sanctions, export controls, or financial regulations.
6. Cancellations, Refunds, and Disputes
- Refund and cancellation terms may vary by event and payment method.
- Diasfrica may investigate disputes and enforce temporary restrictions while reviewing claims.
- Service disputes between hosts and vendors may trigger temporary booking controls, payout holds, account review, or enforcement actions.
- Flyer design disputes, refund requests, or scope disagreements may be reviewed against the approved brief, package limits, revision history, payment status, and any organizer-provided materials.
7. Privacy
- Our handling of personal data is described in our Privacy Policy and Cookie Policy.
8. Service Availability
- The Platform is provided on an "as available" basis. We may update, suspend, or discontinue features at any time.
9. Limitation of Liability
- To the fullest extent permitted by law, Diasfrica is not liable for indirect, incidental, special, consequential, or punitive damages.
- Diasfrica is not responsible for attendance outcomes, ticket sales performance, external platform performance, or third-party promotion results related to flyer design or event promotion services.
10. Changes to Terms
- We may update these Terms from time to time. Continued use after updates means you accept the revised Terms.
